Checking for bad windows

Not sure where to post this question

Before we moved into our current house, we had an inspector go through the house and mark the windows that needed to be replaced. Then the previous homeowner replaced those windows. Now, less than a year later, one of the windows in our game room is fogged up and obviously needs to be replaced and several others are starting to appear bad. Is there a way that we could have checked ourselves to see which windows were bad?

I have a hunch that the previous owner washed some of the windows and did not replace them.

My husband and I could have saved a lot of money if we could have caught this on the final walk through.

Do the window frames look like they are new? If they aren't new and they were told to replace those but didn't, is there a way for the previous owners to be held responsible?

This is a tough situation to look at. I'm honestly not sure if it can fall back on the previous owners. If they lied and didn't replace them, you might be able to get something out of it. However, when you took the final walk through and everything looked great then, you might not be able to do much.
